Get FISA Right asks Congress and all Americans to reject the politics of fear, revisit the flawed FISA Amendments Act, and safeguard the people's rights under the Fourth Amendment to the U.S. Constitution.

During the past 8 years, the Bush administration listened to Americans' phone calls and read their emails without a warrant. On July 9, 2008, the Senate passed a bill to amend FISA, the Foreign Intelligence Surveillance Act, to further expand the government's warrantless wiretapping powers. The Senate also mocked the rule of law and gave telecom companies immunity for any illegal actions they may have taken without having to appear in court.

All 47 of the Republicans, and a total of 69 Senators, voted for the bill.

We lost that round. But it's not over: as soon as President Bush signed the FISA Amendment Act into law, the ACLU filed suit. The case is likely to continue next year.

If legislation to reform FISA is introduced early in the next Congress, it won't be too late to roll back government's surveillance powers -- and to hold telecom companies accountable. We and our allies like Strange Bedfellows and the People's Campaign for the Constitution are getting stronger: we will win the FISA battle in 2009. And a win on FISA will turn the tide, so that we can take on the PATRIOT Act and all the other abuses of the last 8 years and restore our Constitution.

Constitution Day on the Campaign Trail

Get FISA Right is joining with a coalition of groups spanning the political spectrum to urge presidential candidates and the media to dedicate Wednesday, September 17 – Constitution Day – to constitutional issues. We encourage campaigns and the media to focus on the following issues:

    * Separation of powers and checks and balances
    * Congressional oversight and executive branch accountability (including the executive branch's responsibility to comply with congressional subpoenas)
    * The appropriate use of signing statements
    * Torture and habeas corpus
    * Electronic surveillance and Foreign Intelligence Surveillance Act (FISA)
    * Freedom of speech (as it applies to potential whistleblowers in the next administration)
